Dobandirea dreptului de proprietate asupra terenurilor de catre cetatenii straini.

Cetatenii unui stat membru al Uniunii Europene sau al Spatiului Economic European, apatrizii cu domiciliul intr-un stat membru sau in Romania, precum si persoanele juridice constituite in conformitate cu legislatia unui stat membru pot dobandi dreptul de proprietate asupra terenurilor in aceleasi conditii cu cele prevazute de lege pentru cetatenii romani si pentru persoanele juridice romane.

Cetatenii unui stat membru nerezidenti in Romania, apatrizii nerezidenti in Romania cu domiciliul intr-un stat membru, precum si persoanele juridice nerezidente, constituite in conformitate cu legislatia unui stat membru, pot dobandi dreptul de proprietate asupra terenurilor pentru resedinte secundare, respectiv sedii secundare, la implinirea unui termen de 5 ani de la data aderarii Romaniei la Uniunea Europeana, respectiv incepand cu anul 2012.

Cetatenii unui stat membru, apatrizii cu domiciliul intr-un stat membru sau in Romania, precum si persoanele juridice constituite in conformitate cu legislatia unui stat membru pot dobandi dreptul de proprietate asupra terenurilor agricole, padurilor si terenurilor forestiere la implinirea unui termen de 7 ani de la data aderarii Romaniei la Uniunea Europeana, respectiv incepand cu anul 2014.

 

Fac exceptie de la aceasta regula fermierii care desfasoara activitati independente si sunt fie cetateni ai statelor membre sau apatrizi cu domiciliul într-un stat membru, care îsi stabilesc resedinta în Romania, fie apatrizi cu domiciliul în Romania. Acestia dobandesc dreptul de proprietate asupra terenurilor agricole, padurilor si terenurilor forestiere în aceleasi conditii cu cele aplicabile cetatenilor romani, de la data aderarii Romaniei la Uniunea Europeana.

 

Cetatenii straini, apatrizii si persoanele juridice apartinand statelor terte (orice alt stat decat statele membre ale Uniunii Europene) pot dobandi dreptul de proprietate asupra terenurilor, in conditiile reglementate prin tratate internationale, pe baza de reciprocitate. Acestia nu pot dobandi dreptul de proprietate asupra terenurilor in conditii mai favorabile decat cele aplicabile cetatenilor unui stat membru si persoanelor juridice constituite in conformitate cu legislatia unui stat membru.

O societate comerciala, persoana juridica rezidenta sau nerezidenta, poate dobandi orice drepturi reale asupra bunurilor imobile, in masura necesara derularii activitatii sale, potrivit obiectului social, cu respectarea dispozitiilor legale privind dobandirea dreptului de proprietate privata asupra terenurilor de catre cetatenii straini si apatrizi, precum si de catre persoanele juridice straine.

 

Cetatenii straini si persoanele juridice pot detine in proprietate, pe teritoriul Romaniei, case, apartamente sau constructii de orice natura. In ceea ce priveste dreptul de proprietate asupra terenului pe care se afla constructia respectiva se aplica, dupa caz, reglementarile de mai sus.

 

Dobandirea constructiilor de catre cetatenii straini sau societatile straine

Cetatenii straini si societatile straine pot dobandi constructii in Romania, beneficiind in acelasi timp de un drept de folosinta asupra terenurilor pe care sunt situate, pe toata durata existentei constructiilor (dreptul de superficie).
